The General Terms and Conditions contain the conditions that govern the use of this website, hosted under the domain www.bybolot.com, as well as any other that may be determined and the contract that binds us both, Bolot e.U., – you and us – (hereinafter referred to as the “Conditions”). These Conditions establish the rights and responsibilities of all users (hereinafter referred to as “you”/”your”) and of Bolot e.U. (hereinafter referred to as “Bolot“, “us”, “we” and “our”) as regards browsing the website, the rights and responsibilities associated with said condition, as well as the commercial transactions and usage of services included in the same.

By using this website, you agree to and are bound to these Conditions and Privacy Policy, so please read this document carefully. If you do not agree with it, you must leave the website.

These conditions have been designed to create a legally binding agreement between you and us, protecting your rights as a customer and our rights as a business.

These conditions regulate the offer, purchase acceptance and deliver of Bolot products between you and us.

Bolot offers the products solely to end users who acquire goods with no intentions of reselling them.

The “end user” is any individual or legal entity that acts on www.bybolot.com for purposes different from those corresponding to the commercial, business or professional activities normally undertaken.

Some of the notifications or information that we send will be in writing, as required by applicable regulations, so as a user of this website, you must accept that most of the communication with us will be electronic.   1.  Scope of the offer

The Bolot products offered are distributed exclusively within the territory of Austria, Belgium, Czech Republic, Denmark, Estonia, France, Germany, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, The Netherlands, Poland, Portugal, Romania, Slovakia, Spain, Sweden and the United Kingdom.

 

  1. Contract with Bolot & order acceptance 

Until your order has been accepted by us (even if your account has been charged), there is no contract between you and us. If your order is not accepted and we have charged your account, the amount will be reimbursed in its entirety.

After you click “buy”, you will receive a receipt confirmation e-mail. This does not imply that your order has been accepted, since is an offer that you are making to us for a purchase. The orders are subject to our verification and acceptance. We will confirm acceptance by sending you an e-mail informing you that the order is being delivered (Delivery Confirmation).

 

  1. Product returns policy

Any item purchased at Bolot online Store which is not of complete customer’s satisfaction can be returned within 15 calendar days from the day listed on the purchase receipt.

In the event of your cancellation of the agreement and prior to order processing, Bolot will refund the entire amount paid by you, including delivery costs, as applicable. If the ordered items are already transferred to the carrier only the price of ordered items will be reimbursed upon receipt of the ordered items back, the shipment cost will not be reimbursed.

If the recipient of the Bolot products is not the person who paid for them, the funds will be refunded to the person who made the payment.

If you have placed an order for more than one article and do not wish to return all the articles in the order, we will only refund the amount for the articles you wish to return.

Products can be returned by carrier company, in which case you must pay all direct costs incurred in returning them, such as transport charges. Under no circumstances can we accept returns sent with unpaid postage. We will not accept any liability for the loss, delay or shipping to the wrong address of any products you wish to return to us. For this reason, we recommend you send them by registered mail or with acknowledgement of receipt. Likewise, the customer will be responsible for proving that the articles were returned. We, therefore, recommend you always send them via a system that certifies delivery.

In the event of returning products by post or courier, please send the Bolot products and the return form to the following address: Bolot e.U., Gumpendorfer Straße 89/2/23 Vienna 1060, Austria.

The right to cancel the agreement will be applicable provided that the products are returned in the same condition as when you received them, together with their full original packaging, labels and all related accessories. To exchange or return jewelry and accessories, the safety seal must be kept intact. If the returned order does not comply with the stipulated terms, you will not be entitled to receive a refund and we will return the Bolot order products with unpaid postage.

We will determine whether the products are in the same conditions as those in which they were sent to you. You will be liable for all losses in value of the products due to handling, beyond that required to establish their nature, characteristics or how they work. No refund will be offered for returned products that are damaged, incomplete, spoiled, used or soiled due to the fault of the client, and they will be returned to the sender and sent with unpaid postage.

Regardless of the payment system you used, the amount will be refunded as quickly as possible upon receipt of returned items and fulfillment of all conditions.

  1. Product availability

You accept that the products offered by Bolot in the online store are subject to stock limits. All orders for Bolot products are subject to availability.

Bolot reserves the right to modify the products offered on the website at anytime without prior notice.

 

  1. Transfer of risk & ownership

The user takes ownership of the Bolot products when the shipping confirmation is received and the product leaves the warehouse. Liability for the Bolot products is transferred to the user as soon as the order is sent.

For special deliveries please note that depending on the destination and product you may have to pay additional taxes or import duties. Bolot is not responsible for any additional taxes or duties incurred by your country. Please note that customs policies vary widely from country to country; contact your local customs office for more information.

In case the ordered items are returned due to the failure of the customer to pay the import tax a 25% service fee will be charged on processing the order.

We take no responsibility for delays incurred at the customs of the customer’s country. Bolot e.U isn’t responsible for any activities such as missing packages, lost tracking with a shipping carrier or abandoned by customs.

 

  1. Defective product returns

If you receive an erroneous order or a defective product, we ask that you contact us immediately, within 24 hours, at the following e-mail address: [email protected], indicating the error or defect, along with your personal details, on our contact form.

Incidences will always be dealt with from the purchase market.

In the event of problems with the packaging, you must notify the courier service as soon as you receive the order.

We will examine the returned product carefully and notify you be e-mail within a reasonable period of time whether the item will be returned or replaced (if appropriate). The item will be returned or replaced as soon as possible and, in any case, within 30 days of the date on which we sent the e-mail confirming that the inadequate item would be returned or replaced.
The amounts paid for products returned due to flaws or defects, when they actually do exist, will be reimbursed in full, including any delivery charges paid to send the item to you and the costs to you to return it to us. The refund will be made using the same method as that of payment.

 

  1. Product guarantees & information

The products offered on our website are a carefully selected. We have taken special care in showing the colors and characteristics of our products with great precision. Still, each monitor is calibrated differently and we do not guarantee that your monitor shows correct colors.

 

  1. Events beyond our control

We shall not be held liable for any non-compliance or delay in compliance of any of the obligations assumed in a Contract, when the cause is due to events that are beyond our reasonable control (“Force Majeure”).

  • Force Majeure includes any act, event, lack of service, omission or accident that is beyond our reasonable control, especially including but not limited to the following:
    Strikes, lock-outs or other protest measures.
  • Civil unrest, revolt, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
  • Fire, explosion, storm, flooding, earthquake, sinking, epidemic or any other natural disaster.
  • Inability to use trains, ships, aircraft, motor transport or other means of transport, whether public or private.
  • Inability to use public or private telecommunication systems.
  • Acts, decrees, legislation, regulations or restrictions by other governments.

Our obligation to fulfil any Contract shall be understood to be suspended during the period in which the Force Majeure situation remains in effect, and we shall be granted an extension in the period of time stipulated to fulfil our obligation while such a situation lasts. We will make every effort to bring an end to the Force Majeure situation or to find a solution by any means that enable us to fulfil our obligations under the Contract, despite the situation of Force Majeure.

 

  1. Applicable legislation

The use of our website and contracts for the purchase of products via the website will be governed by Austrian legislation.

If you are entering into a contract as a consumer, nothing in this clause will affect your rights as recognized in current legislation.
